Breaking Down the Legal Status of CBD in the US

The National Institute on Drug Abuse states that cannabidiol—a naturally occurring cannabinoid obtained from the cannabis plant—is a compound with numerous therapeutic properties, effective due to its anti-seizure, neuroprotective, anti-inflammatory, analgesic, anti-oxidant, anti-tumor, anti-psychotic and anxiety relief properties.

Yet, it comes as a surprise to many that even with such effects, CBD products was not allowed to be legally distributed, sold or be possessed by individuals in many states in America, until a few years ago.

Thankfully though, with steady persistence along with a push from the scientific and medical community, lawmakers are seeking to make CBD and other medical marijuana products legal.

CBD derived from hemp which contains no or trace amounts of thc is legal in all 50 states.

States Where CBD can be Used for Medicinal Purposes

As of this year, 46 states have made CBD legal, provided that the person has a medical prescription. However, this law varies for each state.

The following 17 states have special legislations in place for the amount of THC (tetrahydrocannabinol – the compound in marijuana that gives the high) in CBD products and the conditions for which CBD can be used:

So far, only four states still have certain laws in place that are quite unclear about the legality of CBD:

  • South Dakota
